Abstract
The juridical analysis of the evolution of the discipline of the use of the cultural heritage is directed to demonstrate the partial gaps that the administrative function of the valorization maintains in the context of the Italian order, under the profile of the insufficient normative support to the actions and interventions of the public administration to support the promotion of culture and private participation in cultural policies
