Abstract
Criminal trial has recently been focusing on scientific evidence: in particular,DNA evidence ensures reliable results. Peculiarities of this evidencecause a discussion in the search for a balance between individual guaranteesand efficiency of criminal justice. This is regulated by Italian Law85/2009, following the Treaty of Prüm. There are four main critical aspectsrelated to this legislation. 1) Coercive nature of the DNA sample. 2) Individuals whose DNAsamples are taken from. 3) Privacy. 4) Reopening of the trial after definitive judgment.
