Abstract
In the judgement, the Council of State confirms that the «in house providing» must be made by the elements of the «effective public control» and the «essential part of activities»: without them, it is impossible to qualify a company as «in house». Private legal entities cannot be part of an «in house» company, because the Directive 2014/24/EU is not self-executing and must be transposed by the State.
