Abstract

The author examines the position of the worker as party of a process, after the reforms introduces in the Italian legal system from 2012. These reforms have deeply changed the balance of power in the enterprises, strenghtening the position of the enterpreneur. To demonstrate this, the author examines the system of loss of the right to act, the limits to the judicial control on enterpreneur’s decision, and the rules on the burden of proof.
