The paper deals with the (non-)registrability of same-sex marriage acts, officiated abroad, in light of the most recent national and supranational jurisprudence. Through a critical evaluation of arguments supporting the negative solution, specially the one of the contrariety to public policy with regard to the necessary heterosexual structure of the marriage in the Italian legal system, the authors argue that the regulation about the right and duties deriving from the marriage is mutatis mutandis applicable. The interpretative proposal is based on the primacy of the fundamental rights in a multilevel legal system.
