Abstract

Referring to the case of Beuze v. Belgium, the judges in Strasbourg appear to be distancing themselves from theSalduz doctrine, whilst recognising the violation of Ar ticle 6, §§ 1 and 3 c) of ECHR. Thus they appear to diminish the interpretation of the EU 2013/48 Directive and other legal sources from the European Union concerning the right of defence.
