Abstract
The essay analyzes and tries to refute recent attempts, both in jurisprudence and in doctrine, to cut out to the obligations of professional facere a specific regime of contractual liability, especially withregard to the autonomous relevance of the causation, the so called material causation, and the imposition on the creditor of the relative burden of proof. Starting from the examination of the objectof the obligations of professional facere, the essay aims to offer a confirmation of the unity of the rules of contractual liability and of the distribution of the topics of proof between creditor and debtor
