Abstract
According to the Italian JudicialSystem, a child under 14years of age is not criminallyresponsible. A minor, lessthan 18 but over 14 years old,can bear criminal responsibilityonly if competent.This paper discusses some ofthe clinical aspects of establishingsanity/competency(‘compos mentis’) or insanity/incompetency (‘non composmentis’) and the legal andclinical implications of declaringan adolescent offender insane– Can he/she be imprisoned?Hospitalized? Shouldhe/she be treated any differentlythan a non minor underthe same circumstances?
