Abstract

The note analyses a recent judgment of the Supreme Court of Cassation. The decision deals with the work done on behalf of a third subject by an employee who is on sick leave: the provision is in line with the consolidated orientation according to which, although there is no absolute prohibition to carry out other activities during the sick leave, the employer’s withdrawal is lawful, when the working activity infringes the specific contractual obligations of diligence and fidelity, as well as the general duties of correctness and good faith.
