The paper aims to investigate the attitude of Vittorio Emanuele Orlando as Minister and Premier during the Great War in the light of the legal principles he professed as founding father of Italian public law, showing his extraordinary qualities in facing the enormous difficulties of the government of an unprecedented war in history and in avoiding that the state of exception could risult into disproportionate liberticidal propensities. Historical judgment on Orlando has been overly influenced by the so-called “mutilated” victory while he deserves to be considered one of the greatest statisticians in Italian history
