To determine if a detailed silence of oblate is fit to draw up a contract, it’s necessary to verify at first if silence or inactivity does not in itself constitute acceptance and then to identify if the contributory situations are able to assume to the same silence the meaning of acceptance. In particular, it should be assessed whether there is no mistaking to behave of oblate, or if his breach of obligation or duty to speak, implies to enter into a contract or not compensation for damages.
